I. Subject matter of the contract
The *client receives instruction in the specialisation agreed in the participation contract and according to the curriculum provided for this purpose. Before the contract is concluded, a comprehensive initial counselling session is held to ensure that participants are adequately informed. The following aspects are explained: details of the provider, overview of the programme, contractual conditions, type of qualification, total costs. On completion of the course, the *customer receives a certificate of completion, a certificate of completion or a certificate of attendance from the Gesellschaft für technisch-gewerbliche und kaufmännische Fort- und Weiterbildung mbH, hereinafter referred to as FUWE GmbH. If the *customer was unable to successfully complete the course, he/she is entitled to a certificate of attendance. This certificate contains information on the content, duration and objective of the programme.
II Payment obligations
The amount of the course fees and the terms of payment are set out in the participation contract. If the fee is invoiced to a third party liable for VAT, the total fees will be increased by the VAT rate. If a *customer is in arrears with the payment of the course fees after completion of the course, FUWE GmbH is entitled to withhold the final certificate or certificate of completion or the certificate of participation until all payment claims have been settled.
III Implementation of the training courses
FUWE GmbH reserves the right to assign a *customer to another course if the person concerned does not attend the originally scheduled course on time for personal reasons or is absent from the course for a longer period of time, which would jeopardise the success of the course.
FUWE GmbH is authorised to change course dates and lesson times, if necessary also during an ongoing course, to an extent that is reasonable for the participants and to adapt the subject matter to current requirements.
If the number of customers at the start of a course is less than 12, FUWE GmbH reserves the right to cancel the course.
The *client taking part in the course undertakes to observe the house rules.
In the event of wilful or negligent damage to furnishings in the school building or to technical equipment or other teaching materials, the *customer participating in the course is liable to pay compensation in full.
IV. Conclusion of contract, cancellation, termination
1. conclusion of contract FUWE GmbH reserves the right to withdraw from a participation contract without giving reasons. The date of the postmark of the written notice of cancellation shall be decisive for timely cancellation. A claim to a seminar place for *customers sponsored by the Federal Employment Agency or the Job Centre only exists if the education voucher/activation and placement voucher/holistic support in accordance with § 16k SGB II voucher is submitted in good time. Paragraph III.3. remains unaffected by this. 2. Rücktritt The course candidate may withdraw from the course up to the agreed course date. The cancellation must be made in writing. Course fees already paid will be refunded. 3. free Rücktritt. Cancellation free of charge is possible at any time by prior arrangement and in agreement with the responsible authorities. 3.1 Außextraordinary KüAuthorisation/Rücktritt If the course candidate has applied to a public institution for funding in accordance with SGB III and the funding is rejected for personal reasons, he/she may withdraw from the participation contract free of charge without observing a period of notice. Upon commencement of employment, the *customer is entitled to terminate the contract for cause at the beginning of the employment relationship without observing a period of notice. The cancellation must be made in writing. This form of cancellation is also cost-neutral for the *customer. 3.2 Ordinary Cücancellation (This regulation does not apply to seminar customers with an education voucher, but only to self-payers). A *customer is entitled to cancel a course lasting more than 3 months with a notice period of 6 weeks before the end of the next 3 months. Seminar fees must be paid by the end of the cancellation period in accordance with the agreed terms of payment. Overpaid fees will be refunded. For courses lasting less than 3 months, seminar fees will not be refunded, irrespective of whether ordinary notice of cancellation has been given. The statutory right of extraordinary cancellation remains unaffected by this. In this case, the course fees are due until the written notice of cancellation is received. Any excess fees paid will be refunded. 3.3 KüFUWE GmbH's right of cancellation FUWE GmbH is entitled to cancel a course participant for good cause in addition to ordinary cancellation. Important reasons include in particular a) Copying or removing software or removing hardware components b) Installing third-party software c) Intentional or negligent destruction of technical equipment, furnishings or other teaching materials d) Violations of the house rules e) Theft of FUWE property f) Spreading xenophobic, nationalistic or racist slogans or writings g) Downloading or viewing pornography from the Internet or other media h) Physical attacks and assaults as well as threats i) Excessive unexcused or sickness-related absences j) Use of mobile phones in classrooms k) Alcohol or drug abuse l) Permanent disruption of lessons and refusal to follow the lecturer's instructions as well as other criminal offences.
V. Limitation of liability
FUWE GmbH shall only be liable for damage caused by intent or gross negligence on the part of its legal representatives or vicarious agents. Any further liability is excluded unless otherwise provided by law.
VI General provisions
1. If additional examination fees are incurred that are not covered by the training voucher/activation and placement voucher, the *client will be informed of this in writing. Learning materials such as textbooks, stationery and hardware are provided free of charge and become the property of the *client upon proper completion of the programme or premature commencement of employment. If the measure is cancelled or terminated before the proper end, the teaching materials shall be returned to FUWE GmbH immediately by the *customer without being requested to do so. 2. Should individual provisions of the contract be or become invalid, this shall not affect the validity of the contract. 3. The *customer participating in the training course undertakes to make independent and active efforts to find a job and to provide FUWE GmbH with evidence of these efforts without being asked to do so. 4. Amendments or supplements shall only become effective if they are made in writing. 5. The place of jurisdiction is the registered office of the company.
